I thought he would end up sued due to misdiagnosis but I guess this works too.

He was never diagnosed to begin with, so you can’t say they misdiagnosed him. They never once told him he actually had cancer, he just assumed that.

@First_Mate_Zoro Yeah I know, when asked he just said how long you could live with cancer not saying he actually had cancer. Thing is that a patient keep saying he'll die and a doctor not objecting would fall into him being misinformed if this was actually taken to court.

Plus the fact that Japanese courts have over 99% conviction rate and that the guy is a politician (god's chosen people) wouldn't exactly help him.

I mean, I’m not a lawyer so you may be correct. But I thought you would have to prove actual injury caused by it. I guess you could argue undue stress, but I was imagining more physical harms.

But I’m not a lawyer, and you seem to know what you’re talking about.

@elbow well, his daughter probably object and plead for guilty if he actually sued dr Koto.

But it's still can't be proved regardless. You need medical records and a prove that you've been given medication of the misdiagnosed disease. (Oh and yeah, political power may affect it too) every disease have differential diagnosis, and time is also a crucial factors too. Assumption is not always correct, that's why doctors need additional examination like x-ray and etc before making an actual diagnosis.

I know I'm not a lawyer, but I'm studying on medical degree right now so I know a little bit. It may vary by the country tho.

@Elbow Politicians are the masters of misinformation, and everybody knows that, the politicians themselves included. They can't thus sue someone else for immaterial misinformation (that doesn't exist in documents). It would open the floodgates of hell and result in politicians themselves getting sued for misformation after the next elections, by millions of voters.
