But that doesn't matter as the cop that was left alive is a witness to the murder of a cop that ment MC no harm. If he only 'killed" the inspector than you'd have a point but he didn't he killed a innocent cop. So MC is now a cop killer and with them finding dead in the basement of the house he was staying at. They have reasonable cause to take him into custody.
