Yes, legally in Japan married couples must share their surename. I don't think Jubei says directly anymore that she is Yagyu Jubei Mitsuko/yoshi, just that she has the family blood. And she's a ninja of the Yagyu.
The author probably forgot about rest of the old side cast from pt2. Mami was already forgotten at the end of pt 2.
