technically, though it may be ok in this case I'll say it for clarity, there are war crimes that can be commited against enemy soldiers. It' isn't just a matter of civilians or civilian infurstructor. Certain kinds of weaponry or certain treatments toward enemy soldiers are still considered criminal.

From what I read from the web novel

They still couldn't rape her, but that doesn't mean they can't torment or torture her body. She is allowed to bathe but the magic sealing ropes are replaced with a collar instead. Anastasia believes they won't be able to break her since she has the protection of the spirits despite not being able to use magic. They lock her up in the dungeon with only bread and water in complete darkness, which they intend to last for a year until she breaks and becomes a soldier of the empire.
