I would guess because that seems like a cheat cause it's like instant death unless you have some sort of cure via magic/pots. All he has to do is bind, then poison stack and instant win.
It's poison from a dragon which are considered raid boss levels.

It's a lesser being, but still he should use the old ones in PvP. Unless in the field, then anything goes
