It's true though. A war crime can only be established as a war crime if the participating belligerents have signed previous rules of engagement stating such actions as going against what was written.

That's where the whole "It's not a war crime the first time" saying comes into play. Cause the first time it's normally a new invention that led to said destruction or the like. Which means there are no rules against said actions till later.
