I had old manga reviews on my site which had mangadex links and naver has reported these as infringement. they didn't contact me before regarding this, then out of the blue yesterday google DMCA strike the content saying it was due to having a mangadex link that leads users to it. the articles are clearly reviews and which clearly had multiple sources including mangaupdates . should I move forward with fair use or not an infringement

Counter claim and sue for damages (mental health, time loss, etc2).Someone with big enough balls and pocket should do it. Probably gonna need some free time too. Good luck.

Personally (not a lawyer, so don't take this as legal advice) I would remove links to any non-official/non-licensed versions of the manga and republish. The link removal is a legitimate application of the DMCA; the surrounding material should (again, not a lawyer) be able to remain. Reviews of copyrighted material are not themselves copyright violations (once again, not a lawyer).

Some general guidelines:
  • A review, as any kind of free speech form, belongs to the writer and as long as it doesn't infringe specific rules from the site it's hosted can only be removed by the writer. If the owners of the site reserve for themselves the right to delete any kind of information then they can legitimely do it any time, though in practice they don't need a reason to (it's always overlooked when there's no profit involved).
  • Any kind of media that appears on a review must be originally public (example: the official digital cover of a translated manga) and be cited properly. Of course, having explicit permission grants you specific usage of certain media.
  • Regarding links leading to pirate sites, you should check the laws of your country to see what you can be accounted for advertising illegal sites but at the end of the day removing them depends on the administrators/moderators of the site it's hosted. Taking down anything from outside means they hacked in and that usually means the whole site being shut down, but the owners of the site can do it on their behalf in accordance with. You won't receive anything in return, except a bitter aftertaste.
  • Don't put sensitive information that can lead you to being charged if you're doing anything illegal in your country.

Thanks for the advice everyone, on google search they have only cited 4 tags Isekai, harem, slice of life , sinen under DMCA, I'm not getting any inbound search from google since I started that website. So I removed the domain from search console. I have emailed my registrar regarding website name downtime hoping to get a favourable response. I only get at most 5000 visitors per month I'm amazed how low they are willing to go, to get even small guys. From now on I'm putting all the outbound links beyond shorturl masking the source.

I've removed the articles since it's only a archive of old reviews , they are still available on wordpress blog site. but I couldn't pinpoint the reason for website downtime. just waiting for a reply from registrar
