And even if you meant to express that it won't be considered rape/sexual assault in court because they already said it'd be sexual, in this case, and more so considering it was a bet to see how far they go, once one part says stop it's stop and a perfect argument to point out who won, it's not "I keep going because we're betting", you'll go to jail with that mindset. . .
