First part, I agree. Involving MCs power is damn stupid, though. That's like pointing out that anyone capable of killing someone (i.e. literally
everyone) is a danger to anyone around them. Meaning, everyone is always in danger while also being a danger, which makes society entirely meaningless. MC deserves punishment for what he's done, not for what he's capable of. Swordmaster deserves punishment for escalating the situation and acting as judge, jury, and executioner without a mandate.
