No its just bad writing, he has constantly subconciously stolen things also he could have just taken the necklace earlier. The writer wrote themselves into a corner but wants there to be stakes in the story

He really needed to at least try to steal things, not just gloss over a single instance of her having defensive magic and then not even make any attempts.

He could steal that staff, he could steal the gun, he could steal the bullets, he could steal the ring, he could steal the necklace. The Titanic instance especially made no sense why they had to draw any attention when they could have just walked out with the ring long before anyone noticed such a tiny item was missing.
What happened to his ability causing Fran to lose her momentum, practically freezing in midair? If that instance wasn't just poorly portrayed, he should be stealing individual pieces of clothing to stop people's movement then.

You would assume someone with the ability to steal items/clothing instantaneously at a distance would always try to steal weapons.
Instead he lets himself gets beaten with a staff or just watches someone dope themselves up on drugs.
