Then you'd say the same for a drunk dude raping someone?

It's not just about consent, it's about how much control you have over a situation.

Yes, actually. Alcohol usage tends to remove inhibitions and eliminate impulse control, often reducing people to baser instincts. It is only fair to apply the same rule to a man who is unable to make an informed and conscious decision because of alcohol usage. Now, do I think that they should get off scot free in the case of an actual rape (depending on the severity of his actions)? Of course not. However, the inebriation needs to be taken into account since the man was technically by the letter of law, not in his right mind.

Now, do I think that they should get off scot free in the case of an actual rape (depending on the severity of his actions)? Of course not. However, the inebriation needs to be taken into account since the man was technically by the letter of law, not in his right mind.

I disagree, rape is rape, whether intended or not, whether under the use of substances or not, rape is always rape.

The only circumstance I think potentially voids this is if the person is forced to take a substance against their will and loses consciousness. Then both are victims and the person who forced the substance on then rapist is to be held accountable.

If you willingly take a substance than force yourself on someone, you are 100% at fault regardless of impaired judgmental skills or consciousness.

I say this as a habitual drug user who's heard every damn excuse in the book for people doing horrid things.

Again, I never said that the man commiting the rape should get off, because he did perform the action. But being under the influence of a substance known to impair judgement and remove inhibitions SHOULD be taken into account when it comes to sentencing and such (depending on the perpetrator's actions).

Circumstances and context are important when it comes to justice for crimes committed. Otherwise everyone would just get the maximum punishment for everything.
