For all we know he's on the lease/deed, and I don't know much about JP law, but I know parents have a ton of legal rights and nobody's tripping over themselves to interfere with that over a little abuse. If dad gave mom custody and mom's in the hospital, dad's "custodial interference" might be looked at as a civil matter, and the random teen boyfriend winds up in cuffs.
