No he's not the victim here =.= I paid for the newer volumes cause I was curious and it looks like he confessed to emi and initiated the physical contact during a time they were talking about something emi was worried about. I cant read iapanese but from what i could see and understand emi was feeling vunarable about something and he took the chance to shoot his shot. When I google translated the Japanese comments some of them were saying he did it to feel bigger than his friend. The japanese readers hate the guy.
