It's a widely misconception (to my understanding).
The shutter sound is actually programmed based on your location and service provider.
(phone plan, SIM card, etc.)
not the hardware
For example, my phone, if I'm outside the big cities, the camera won't make any sound.
But once I entered Tokyo or Osaka or Kyoto or most major city coverage, the camera will make a sound.
Since phone carriers in Japan are generally locked-in, that's why people assume the camera sound is because it's built into the hardware itself.
And there are phone carriers that no matter where you are the camera will make a sound.

I believe you can report to the police if your face appears in someone's photo and you want it removed.
That's why Japanese TV always blurs all pedestrians caught on camera.
