I would assume that they started translating at the same time and the person just failed to do it faster than Mylene did it but who knows. As long as this person is the only one uploading to MD a whole lot of people are only going to see their version so they might just not care.

I feel like the only party that should be scared of DMCA are the host sites, and not the scanlators. Scanlators can always just keep going and move onto another site when needed. Just don't be a dumbass and keep a chapter archive of prior TLs on hand at all times. The industry isn't going to go after you, they're gonna go after the hosts.
