My guess is that he surrender because:
1) it take them longer listening to his bs while also searching for stuff
2) have easy access to their higher up as he is "weak"
3) he's lazy
If he did fight head on, & I was in the search party, I would have a few guys captured/kill him while having the rest of the party rush past.

Kail's mother is a magic user. Seran's a fighter. It stands to reason that he inherited much more melee power.
