If the Crown has so little power what's the point in having them ? might as well rule as duke council with the head of the council rotating between the dukedoms.

because they still benefit from having the status quo, if they just declare the king isnt king anymore then someone can declare they arent dukes anymore just as easily, they're power is maintained by respecting tradition and benefiting from that stability

Yep - and that's why what the queen is doing here is as risky as it is important.

Her basically unilaterally saying "you aren't becoming king" directly undermines the very authority by which the royal family claims its right to rule their nation.
But, if Dale were allowed to ascend the throne, it would guarantee the royal family's destruction, along with the rest of the kingdom, because of the sheer ineptitude of his character. And the fact that someone of his caliber would have been given the throne if all of this hadn't been exposed, is another argument again of the ineffectiveness of hereditary rule.
So the queen was boxed in just as much as Dale was, here - she can't let Dale take his father's place, but she can't just go "you suck, get out".

And so Lunaria's "trial" gave the best opportunity, by letting Dale hang himself in front of everyone important enough to be at a ball like this - they all see for themselves just how horrific of a future he would have meant for the nation as a whole, and the queen could secure the crown's power by showing she means to preserve the throne and its integrity, by removing a bad future king, and by coming to the aid of one of her family's four primary pillars of support - all using what Dale himself set up.

Which means it doesn't appear like some sort of witch hunt or kangaroo court, which in turn once again protects the image (and future) of the crown.
