Inside the dungeon a lot of sophomore students LOVE to do both to new students in the shallowest levels.
It also only happens inside the dungeon because general students cannot use skills outside the dungeon making them weaker.

Spoiler: Outside the dungeon

There exists a disciplinary committee of 5th-year students (the last year before graduation, so they are -without counting anomalies like what the MC become later- the strongest students in the school) to stop really violent crime (like mass murdering attempt). However dozens of students disappearances are reported every year, so as long as it is not a big enough mess, they won't intervene.
R#pe is tacitly allowed by the school because in a nutshell, it allows the school to control its students more easily. it is also better for the school economy (and no, I'm not kidding) since it motivates everyone involved -directly or indirectly- to grow stronger in the dungeon, henceforth bringing more crystals and loot.
