I think the rules allow for older translations from former license holders of in-print works. (Battle Angel Alita was retranslated and unflipped when Kodansha got the license. This is the old flipped translation by VIZ)

Indeed, the rule says "If a different publisher has created a different official release, the ex-licensed release from a previous publisher may still be uploaded."
