If it was uploaded before but it's not being uploaded anymore
For example
The last chapter was 23 (eng)
But the series last chapter was 76 (orginal language)

Okay, there's no problem if you're translating yourself.
Sometimes scan groups restrict who can upload their chapters on Mangadex, and if you're not a part of them you can't upload their chapters.

No, but thats not really the answer to the question you are actually trying to ask.

Is it illegal to obtain a work translate it and then distribute that work? Depends.
Copyright law varies widely depending on where you are. Generally speaking the best case is that its a legal grey area if the work is not licensed in your location, otherwise its likely against some sort of IP law.

Don't do things that are illegal. If you think doing something is illegal where you live and are afraid of the consequences, DON'T DO IT.
