Uploading official translations is against MD rules and grounds for being banned from uploading.probably because they uploaded official translations on top of fan translations
It's less of a grey area if you're trying to profit off of scanslation like Flame Comics does. Being able to say that you're not accepting donations, ad revenue, or putting your scans behind paywalls is a sort of legal fig leave to cover your ass with. You'll still get in trouble, but you're a lot less likely to get nailed for losses and punitive damages. Publishers don't like illegal copying and distribution, but what they like even less is people making money off of it.scanlating was always kind of a legal grey area, some of it was/is kind of a matter of time
