The problem here is the 'non-consensual' part. He was legal at the time, she did ask for consent and pretty much received it. <- Those are the facts, no need it to discuss it further.
The argument more or less revolves around his drinking alcohol before the act. The 'rape' faction claims that he was inebriated and thus unable to give the consent while the 'not-rape' faction arguments that he didn't drink enough to affect his judgement. So there is that.

No, there is a ton of other things that make it shitty thing. I've read plenty of josei smut that had drunk sex and didn't felt as rapey. This is so badly received because it's a combination of:

• guy is first time drinking, and completely illegally according to Japanese laws, which wouldn't be much of moral problem just in itself, but is much worse when people claim he was in control when Japanese law states directly that he's too young to even decide to drink alcohol. She also knew he didn't realize how much he drunk due to mistake with the drinks
• Ekoda never implied she wants to fuck him before they went to bed, which meant he didn't know she could want to fuck him before sleeping in her room, but she didn't even ask him when starting fucking him in the middle of the night while he was not only barely conscious, but also either still drunk or hangover first time in his life
• she took hims first time, in the night like a thief, and he was clearly regretful in the morning, probably because she was clearly doing it due to her history with his father, and because he didn't want to get into mess like that, and once he woke up he was clearly taking it as mistake on his part. That's fucking shitty thing to do to him, and it's even worse since it was his first time, that she wasted on her dumb regrets or hang-ups.
• it was also clearly messing with his slowly developing romance, romance that she has no way to compete since she only treats him as replacement of his father, which makes that whole taking his first time when he was too drunk to object even worse, especially since she has no way forward with him anyway, so she just fucked with him for no real benefit even to her. She basically admits to taking him NTR style just because some other girl did the same to her, which apparently makes it fine to mess with high-schoolers

She's just a shitty worthless selfish character that can't let go of her past, and wastes everybody time and damages them emotionally despite nominally being the oldest and most mature one in the cast. She just sucks, even if you ignore the whole rape/consent thing.

Edit: Also, I find it funny how everyone brings Shirasawa's drinking, but completely ignore/dismiss the fact that Ekoda was most likely more drunk than him when she decided to snuck in his bed.

I'm mixing things because it's the mix that makes this whole scene and her character so widely disliked. There are plenty of age-gap romances in various manga, including sexual ones, or drunk or otherwise not-properly-consensual sex scenes, but the combination of the way it happened and her character and her role in the story means she is basically the NTR character in story of a crazy and kinky romance between two kids, stealing guy's first time in at least very dubious circumstances and leaving him regretful in the morning. And most people hate NTR with passion.

Look at the sister, people react more positively to her character because everybody hopes MC will get shimaidon with sisters, making them both happy and healing their sibling relationship with the power of dick. Meanwhile all Ekoda has to offer is guilt and shame, and she knows that. That's a big part of why people don't give her a pass.
