@dahhv2 Eeh.. If you truly believe that, you gotta go train your reading and story comprehension skills somewhat.
1. The kneeling pose is a classic samurai drama "I've been cut up and am about to fall forwards, dead"
2. His wording as he staggered away was "If I made even one wrong move, the one who'd be lying there would probably be me." (Lying means that at the very least he fell fowards. And that he was in a worse state than nearly-dead MC.)
3. If he hadn't killed him, the storyteller wouldn't let you miss it, since that'd have been a "character trait of kindness" that has to be rubbed in. (Seems to be necessary to keep it all ages.) Plus the bad guy would have gone through another four pages of ranting.

On another note, I dunno why people are so upset about MC not killing people.
It's all a saga or made up story anyway.
The bad guys will return if the author wants them back, doesn't matter if they lived or died. (Especially not in a story world where they can be recreated by science, or by magic, or just by being full of piss and vinegar.)
