First of all, they only discussed the possibility, as Ferdinand simply asked if he would be willing to adopt her. More importantly... Why would simple intent be a breach of contract? That's like expecting water to come pouring out of a faucet on its own just because you were planning to turn the valve; that's just not how causation works!
