In hindsight these are the kind of policy/strategy that should have been decided by the capital before they depart. Or at least, the command hierarchy should have been clear.
Unless of course, all of this is a ploy to create a precedent (and a show) on how Qin would treat the conquered from now on.

That shouldn't have even been a question, they're still in war-time conditions meaning Tou is in charge. The Governor of Hawaii had no authority over MacArthur during WW2, he only answered to the President as the Commander in Chief.
This is no different, Tou answers only to Sei.

As expected, Qin very much intends to impose its numerous strict laws on all conquered territories per the doctrine of Legalism.
Not sure why the royal court has not already made clear who is in charge of conquered cities in wartime or came up with a policy framework for treatment of occupied cities and civilians before this. It would be interesting to see if Goukei would just decide to do what he wants in Nanyou once Tou's army eventually departs for assault on Shintei making him the highest official in the city.
Honestly surprised that one of Tou's main generals would just threaten to leave him like that and this comes off as very unusual especially for back then when retainers would normally prioritize loyalty to their feudal lords rather than follow the laws.

You could simply use Kanki in field battles or defensively.
But also, Kanki's whole thing was that he was a master of psychological warfare. If sparing the citizens would grant a psychological advantage in upcoming battles, I think Kanki would do it. And vice versa for slaughtering them if he thinks it would break their resolve or something.
