In a case of that sort, one makes the perpetrator drink the drugged drink; and, once the results furnish proof, one takes his testicles, teeth, thumbs, and eyes.

@BanditHadron considering how many "criminals" are exonerated post-execution, I'm more of a "life imprisonment" kind of guy myself, unless you plan to keep their balls on ice and stitch them back on when you inevitably castrate the wrong person.

I wonder if mind reading would improve the justice system (catch criminals who wouldn't normally be caught a prove innocence) or if it would just be used to fine everyone for minor things like traffic/drug violations and important cases like embezzlement would just bribe the mindreader into lying.

@HiraOmnibus It would probably depend on mind reading being detectable in some way, be it through tecnology or other means, because giving people the ability to use mind reading as evidence in a case without being able to confirm the reading would definitely be abused.

Any state is always some group of people who have established a monopoly in the overall control of violence. No part of society has some peculiar entitlement to be the state, though every has a right not to be treated unjustly by the state. I cannot read minds, and so if I somehow got such power I couldn't reasonably behave as if I could read minds. But Kitsune can read minds; and, if she has the power to act on what she knows, she can be the state. The only reason then that she might do as I previously suggested (forcing the perpetrator to consume the drink) would be to reassure people that the state were just.

One could use mind-reading as part of the investigative process even without allowing its results to be entered into evidence.

If mind-reading required probing, as opposed to thoughts basically just leaking, then it would be a form of search. So it would be desirable to require warrants or permission of the target for its use, and to treat results got from mind-reading without permission and without a warrant as fruits of poisoned trees.

@Oeconomist Huh. So it could be something like those spirit detectives shows who use a ghost's testimony to know where to look for evidence, but not as evidence itself?

Essentially, yes. And like real-life profilers; their work is not evidence — it's conjecture, often without even a good statistical basis — but it can guide investigation.
