That whole “ThEy CoUlD gEt SuEd lolilol” is nothing more than corporate bullshit to justify not having the basic decency of feeding the poor rather than the trashcan. When you’re grasping at straws to the point of having to buy expired food, you don’t have the financial leeway to pay a lawyer good enough to go against a big corp.

That's why food banks and such are so important, the middle man that takes on the logistics, optics and some of the costs makes it much more attractive to give away the expired/almost expired food for some easy brownie points

Yeah, the optics, you’re perfectly right. That’s probably the most important aspect, and the most infuriating.
Couple years ago, I managed a public elementary school. Kids being kids, we always had some (undistributed) leftovers after lunch, a lot of it in neat little packaging, but it all went straight to the trash. So I advocated to give it out to whomever wanted it. Logistics and cost: zero. Instead of putting the food in the bin, we just had to put it on the lid of the bin, and whatever was still there the next morning would be taken away by the garbage people. Even better, the bin was in a back alley where the kids never went, so no risk of having some… interesting… encounters.
But the mayor told me that if the citizens saw that we had leftover food pretty much every day to give out, they would think we were buying too much, should reduce the quantities, and in turn reduce the price they paid to have their kids fed. All while these fuckers paid less than half the real cost of the school lunch, the difference being discreetly subsidized by the town!! So in the end, only the people working at the school were allowed to bring some leftovers back home, as long nobody saw them doing so…

Damn that sucks. He was probably not wrong though, the way goverment subsedies/budgets work tend to be synical like that.
