We are mostly saying the same thing but we are not understanding each other because words are hard. I'm just pointing out the difference between licensing and copyright. You can't and won't get in trouble for just distributing unlicensed but copyrighted material. There is no actual way to avoid trouble if you are distributing licensed material in any way. In the case of piracy it's usually a mix of both: for movies, books and the like, it's unlicensed distribution of an unmodified work (doesn't have much to do with copyright); in the case of games it's illegal alteration of copyrighted goods (and later distribution of licensed material).
