If the old man somehow has good conditioning but bad base balance its not gonna make sense, esp since he looks atleast 15 kg heavier than a hoghschool boy, how tf is gonna get into a submission and unbalance the guy (im guessing some flashy jumping guard that seems to be popular in jmma but idrk)

The manga says that the tournament isn’t a standard one. Says it’s a fight without rules. Has shown times before that playing dirty is perfectly viable for ”true violence”. Akita is fully capable of winning just not in a straight fight so unless he magically conjures a gun out of thin air, nothing bout he does it will be an asspull per say (lest Akita gives the old man a nasty wedgie, making it a literal asspull).

Like you said, if Akita wins this fight via hand to hand combat then yeah it is an asspull. Even if it's dirty moves like hits to the groin or eye pokes it's still an asspull, the only time it wouldn't be is if finds some sort of weapon nearby.
