sigh Every once in a while we have to go over this again, it seems, because people think they can ignore the basics of commerce and copyrights...Also what stupid thing are you saying about don't ask scanlators to do chapters that have official versions? You can't upload the official, but you absolutely can still translate the raw. Yes the last DMCA wave was bad, it was total nonsense and overreacted to, hitting things that were perfectly fine. It was not scanlators fault it was panicking mods just nukeing things.
Scanlation will always be a Grey Area, but.... As long as japanese publishers do not intend to publish in other languages, or sell the rights to do so to someone else, you're pretty safe.
There's only costs for them to chase the formal breach of copyright, and they generally don't care what happens outside of their main market. If anything it even slightly boosts sales for them. A small secondary market they can even use for promotion purposes.
This changes when someone pays for the official publishing rights in the language(s)/Copyright Zones a scanlation is published in.
At that point you're not dealing with a japanese publisher, but a western ( usually US ) publishing house. With the lawyer clout to shut you down. hard. expensively.
Because you're directly competing with them, while not having the Copy- and Publishing Rights. That's a legal slam-dunk.
Official Publishers are relatively slow in publishing, so you can generally get away with scanlating new chapters as they come out in japanese. As long as they're well ahead of the official publications, and the scanlations are not too high of a "quality".
As soon as you start scanlating and publishing chapters that already have an official translation, you're walking straight into a legal minefield. And the minefield will win.
You can scanlate/translate stuff perfectly well for personal use, even pay others to do it for you.
But if you publish them on sites like MD, you're openly inviting a shytestorm of potential, and as we've seen, quite real Trouble.
Which not only hits MD, or the scanlator, or even, if they feel like tracing things back far enough, you.
It also hits everyone else. Because Stuff will disappear. MD clearly states so.
Just because some asshats with Opinions don't heed the warnings, and keep poking the Bear when it's clearly Ill Advised.
Like requesting to "fill in" chapters which already have an Official Translation, because they "Don't want to read Manga with chapter gaps"...
