I really want to see the reaction on the judge's face the first time the defense brings that up.
Imagine being the defense lawyer that needs to explain what a loli-baba is to a bunch of 60 years old judges. Might the the peak of a career.

Do you guys know about New Jersey's laws when it comes to self defense? If you're in your own home and there's an intruder with a gun, you are required to flee your house, even if it's through a window. And if the intruder then chases after you, you still can't shoot them unless there's a 0% chance that you can get away. But even then, the police will probably still charge you with 1st degree murder.

I live in New Jersey. What's the point in owning a gun? You're not even allowed to shoot bears with it in self defense.

That has always astonished me the fact that criminals would have more of a right to your property than you yourself and the fact that even when you or god forbid your family are in danger you still can't defend yourself without ramifications.

So I would think there's a fair bit of space to argue just under the 'patently offensive' banner.

Also note that the cops can't just grab your phone or break down your door and demand to see what you've been looking at - they're going to need a warrant. So there's going to have to be some reason to try and enforce this law to start with. Admittedly, if I owned a bookstore, there would probably be some material I might be more concerned about carrying if this law takes effect, but I'm not super concerned about my personal collection.

Finally, consider the number of characters who are at least 18 in manga/anime who are drawn exactly like characters under 18. Komi-san and her mother come to mind - literally the same character design with different haircuts. If all the characters look to be the same age, and some are certainly over 18 and some are certainly under, this entire exercise becomes so impossibly subjective that it's going to bog down in appeals going back and forth. Not sure that results in a favorable outcome, but there is the broader question of whether the courts really want to be in the business of adjudicating how old all the characters look. I suspect they don't.
Quick fix: All the characters will have huge breasts.

Looks like this will head to SCOTUS. But then SCOTUS once said: "I know smut when I see it." This going to get so beat down. SCOTUS does not like vague definitions. Are they really trying to get ahead of AI Pedophile generated material, so badly they screw up any truly needed legislation in the future. Trust me it will be needed. AI is growing leaps and bounds, GAI is so close to coming into existence.
