IMHO it just seems like something they created to cover their own ass. I wouldn't be afraid of MD taking down your content themselves without a DMCA notice from the copyright holder (which is, historically, pretty rare). If you are worried about being sued or something, I guess it can't be helped. I doubt most distribution sites make you claim you are the copyright holder, which I assume would make you culpable for any supposed damages if the copyright holder tried to sue (which I do not think has ever happened to a scanslator, but do not quote me on that).

I expect they mean it more as a "you hereby agree it's your fault that there's pirated content on our site, not ours, so no company can sue us when they come complaining" kind of disclaimer. A wink-wink-nudge-nudge clause of hold harmless, with hopefully the addition that they don't know your full identity and thus can't really hand you over either.
This opposed to a clause of indemnity, where you'd be forced to compensate them in case your upload causes legal trouble.

This is pretty much the case on all websites that allow people to upload content on them, only difference between any of those is how lax the moderation is. You can't escape this, and in fact by hosting your own website you're more at risk of issues from the rules on your host than from this content policy, probably. Meanwhile since they haven't deleted this series, once can presume Mangadex remains just as lax as they've always been, only taking things down when they have to.
