The town is the MC's biggest asset at the moment, but whatever he gains through the war is his to keep. This includes any potential cities or fortresses he conquers. The only reason why the border town is important here is because the MC is fond of it. Destroying the town while he is away fighting the war would only needlessly aggravate the MC. Admittedly, it's pretty clear he's already setting up against the crown, but such an act would utterly eradicate any slight chance of amicable co-existence that remains.
He's already hostile, but it's not to the point of overt action. As it is now, there is a chance, small as it is, to cool the temperature. Destroying the town will guarantee retaliation. And yes, he would have no chance winning a drawn out fight. The only reason to keep the town would be to get into a schemes war with MC to try and drain him dry using the town as a hostage.
Lets be honest, no way this king would have a shot at winning such a fight, letting MC go away as far as possible with as little contact as possible has to be better than such a confrontation.
Also if MC only has the conquered land, you could say that he's outside the range of clause 1, allowing the king to straight up attack him since hes outside the borders of the kingdom depending on how you spin it.
Well you could do the same with the town but that would be far less convincing.
considering the plot so far, the 5th condition, the implication of the other conditions, and the Holy Sword choosing the king, I would be more surprised if he doesn't simply start his own country, overthrowing his brother after this warSo... MC takes on the ENTIRE war effort on his own and in return gets to keep the war spoils he earns, gets a minor lump sum of gold and some half arsed guarantee of safety.
Honestly this is a great deal for idiot king. Imagine if you could win a war with that little, who wouldn't take it?

Easy, just be fighting on another front. Could also be luring them into a trap, let through and encircle. If he lacks the forces to fight head on, he only has to fight where he can.The first statement of the blood contract is "I, Raidorl Zain, will fight to protect the Kingdom of Zain from the Arsline Empire"
True there is no stipulations on how he would fight, but it would be rather hard to justify letting the Empire take the capital of their nation and still say he made a good faith effort to protect his kingdom.
So I think he would rather just take the empire's capital and rule the larger nation.
