Exactly, so it's either accepting the sale as fraud, which means no one gets it or they pretend the sale was somehow still okay, which would mean the lord bought it first and also he is the fucking lord so MC ends up with it. I mean it was quite obviously a setup to them having to live together from the beginning but I am still annoyed about it

The owner died in the big upset, so it was an abandoned home, which the merchant guild picked up and then resold for a highly inflated amount, to Lily and the Duke; a scheme that they had been carrying out repeatedly with other houses, and Lily's house wasn't meant to be in the group that went to the Duke due to the chances of something like this happening.
Correct. He also bought it AFTER Lily bought the deed. This place operates under pretty standard paper title claims, where you hold a deed made the right way, and that deed is legitimate, even if there's multiple. When that's the case IRL, it goes to adjudication, or lawsuit; there, it might come to the Duke parcelling out another home for them, maybe, since he wouldn't want to annoy a rank B adventurer OR the Heroes.
