All the novels and related writings are already public domain in New Zealand, but in some places it might not be until 2092 that everything enters the public domain.
In the USA, the series will be enter the public domain between 2031 (The Hobbit, 1st edition) and 2050 (Return of the King), but those using it may run into issues with the rights to some of the notes persisting until 2072. In other places, the rights don't expire until up to 70 years after the author's death, creating the 2092 figure for the entire series even if the works by JRR will be entering in 2043~2044.
