Just like @ Australis said, he could asked to transfer the curse to someone who is very close to die.

and how exactly do we know the curse wouldn't take out some doctors or loved ones of that person before they realized what was happening? The duke's whole deal is not wanting to harm anyone with it, period. Are we even sure the curse wouldn't persist on a dead body anyway? The caster's death didn't make it go away either. That could mess with anyone who ever tries to move the remains for burial or just stumbles upon them later on after people gave up trying to move it. Imagine, hundreds of years later some person investigates an "ancient supposedly cursed area" and finds the bones. There's another casualty or more each time people end up forgetting the curse is actually real.

If you wanna foolproof this at least think about the potential consequences a bit more before saying "Yep, that'll do it." When we're talking about instant death on contact, it probably pays to be as cautious as possible.
