Gotta respect the francois commander, he's capable of confronting our god-strenghtened loli with only his own power.

Poor Tanya! She is doing everything according to the international rules of warfare to make sure that her ass is covered...

...BUT...

Historically speaking, it's the WINNERS of a war who determine who will be charged with war crimes. As shown by the results of WWII when the Germans lost and were charged with numerous war crimes, but the British and the Americans were NOT charged with the crimes of firebombing the cities in Germany and killing untold numbers of civilians in the process.

War is HELL!!! The Winners will almost always get away with atrocities and the Losers will always get fucked. That is just the way it has always been. Hell, in pre-modern times, it was common practice to wipe out an enemy to the last man, woman and child in order to eliminate the possibility of any future retribution and revenge by any survivors. Very brutal, but also very efficient.

D:"You don't want this smoke"
Lt.C:"You don't got not gun"
D:"I got smoke"
Lt.C:"YOU BETTER NOT"
D:"YALL GETTING SMOKED"

The basic plan is to GTFO ASAP, because there is no greater rainstorm than artillery fire, and urban combat just sucks ass.

That was a good advice. The first job of a soldier is to stay alive.

Leave thinking to the higher ups. Or quit being a soldier.

... or in the case of America, nuking Japanese cities full of civilians.

I think the real reason why she's trying to abide by the laws of war is different.
If the Empire is too obvious with breaking international laws, they'll give every other country plenty of reasons to go to war against them. They're already struggling with keeping Britain off their case, and America's right around the corner.

If Tanya were the reason why other countries ally against the Empire, she might face trouble within her own country. Worse if they lose, because she'll be judged for those crimes.
Even the current situation puts her in a very sticky situation, because once the Empire loses, the remaining countries could still charge her for twisting the definitions of international laws. She probably knows that, which is why she's uncomfortable with putting her plan into action. At this point, all she can hope for is the Empire winning the war, because she'll have a hard time justifying herself if they don't.

As they say, the victor is the King and the loser is the villain.

we all know the empire is gonna lose,
Tanya became a ghost after the war, nobody knew her but they all know of how the devil of the rhine massacred an entire city because she is just too stupid to recommend it lol
why does he have to be so all over the bush when explaining shet?
all these scenarios could've been avoided if she said what was on her mind honestly and not recommend things that are too extreme.

@greyhud90 not sure why you think the empire is gonna lose. At this point, history has already largely deviated from out world. In the first place, the setting was never quite the same as ours, even before Tanya showed up. Her advantage comes not from knwoledge of specific historical events but from general tactics and developments in warfare.

I don't think Tanya have any problem when the empire lose the war, just look at how in our history Russia and usa recycled all the talent of Germany, even truly war criminals, and we know for sure Tanya's name don't show in the historical records because someone cover up her.
The strange thing is the empire managing to keep Doktor von Schugel after they lose the war.
