Not a problem if the new servant has a short shelf life/is already dying, has some form of off switch, no free will, or the fight is close enough that whoever wins will be severely wounded.You have a loyal op servant, the only way to kill him is to have another loyal op servant. Congrats you are back to the start line with extra steps.

This is one of the most glaring and common worldbuilding flaws I've seen in nearly every modern fantasy series. Even supposed harem "trash" like Familiar of Zero made more sense by making magic exclusive to nobility.

Depending on how strong the average persons' magic is, how magic aptitude is inherited/works, and how inherited nobility tends to work, the king could easily be the descendent of a great warrior, like how many real world nobles were the descendents of the strongest individual at the time who used force to be put in charge.
It really depends on a lot of factors not explained as they are not important enough to need to be in 90+% of stories.
He might not know. He knows the hero follows orders pretty much exactly, and he said come alone. On top of that, his answer to "oh no, I made too powerful a tool, how do I cut him off?" Was to make an equal/stronger version.The king must be brain dead he really gonna send out these goons to take on the hero? Does he not that his family is literally in the capital?
