Generally it's a wash. They are both kids and therefore not fully accountable for their actions. It would probably depend on the jurisdiction though, so results may vary.
I don't know, but I don't think they could be prosecuted either way
So, if the kids are not fully accountable, then the ones to be held accountable would be the parents, right?

Given that we're living through Heinlein's Crazy Years, who knows how bad things are going to get? Back in the days, two kids of close age caught in flagrante delicto (Lat., “while the crime is blazing”), from were usually just wrist-slapped, and the girl would be informed by her mom of the possible consequences of actual "S-E-X."

In Washington state as an example no-one is accountable for the situation. But our consent laws are tiered and complicated and I last learned about them 15-20 years ago in freshman health class so I only remember the abridged version. Basically assuming neither one is unable to ever consent (mentally retarded people cannot consent under any circumstances as an example) if the age disparity is too great the older one is at fault prima facie. The age is based on the younger of the pair pair; a 10 year old as the younger one and a 14 year old as the younger one have very different allowed maximum partner ages.
