So this shows a pretty basic level ignorance of how the court system in the US actually works. Taking a case to court is fucking EXPENSIVE. Even if the material SHOULD be protected by 1st Amendment, proving that the law infringes on it wouldn't be cheap. Lawyers cost money.

Perhaps it was intended, but I have no insight into that and am left to interpret the words on the page by themselves. Given the lack of pronouns in the first three sentences, and the use of the conditional preposition in the fourth, there is no reason that disagreement with the former would necessitate the assumption that one belonged to the class described in the latter.
