MD said they are always respect the groups decision, this can be seen on Jaimins drama thread.

though a really old one group I suppose can be made an exception, since if the really "old" group is not active or the owner of said group dies or decided not continue or disband the group and when PU trying to contact them and none are respond to it I guess you can upload it.
For the "dex" in mangadex and for archive since a really old mangoes that are literally being "scanned" and translated is hard to find nowdays.
Only a few that I know that still have scanned chapters, since im new to this scenes.
