Damn uhm... I guess it's because he technically didn't successfully do anything, and in this conversation, he downgraded himself and his feelings so much and kinda swore to himself never to touch Eri again, that's why I can forgive him but not thinking highly of him
But then again... Fuyuki also did force a kiss on Eri.... the 2 scenes between Kyou and Fuyuki kinda similar, they tried to do the same thing, kissing out of rage
I also dont think Fuyuki would see someone as a brother if he assaulted Eri, but like as in, FOR REAL assault, Eri rejected him quick, and he also backed to his sanity quick right after
You make a valid point that Fuyuki (also Eri) and Kyou both forcibly kissed someone without their explicit consent. In a trial of sexual assault (a forcible kiss is still considered for-real sexual assault), all of them would be found guilty. If we didn't consider a forcible kiss for-real sexual assault, would the situation change if Kyou were a stranger, or if he were a much, much older man and Eri a much, much younger woman?
But there's an underlying assumption when we state that he didn't "successfully" do anything. What was he trying to do? If I were Eri in that situation, it wouldn't be a reach to assume that Kyou could have raped me or further escalated the issue, whether that'd be violently or sexually. This might be an exaggeration, especially considering their prior history, but Kyou is a young, fit man who was dragging Eri into a secluded area. After he dragged her away, he was yelling at her face, saying that she didn't understand what she was saying. I also have to say that most rapes are committed by people you know - family, friends, neighbors, etc. Even the narrative frames how fearful Eri was at that moment. There are tears in her eyes as she glares at Kyou with disgust. She had to kick him away for him to gain "his sanity." What happens if Eri were too fearful or shocked to stop him?
Like I said, the cherry on top was that Kyou immediately had sex with a different woman after he assaulted Eri. We can argue that this was out of hurt from rejection. But we can't deny that he had some sort of sexual intent - whether that was pointed at Eri, or released onto a separate woman.
Never once did the author frame Fuyuki's kiss to be particularly terrifying. Eri is confused, perhaps hurt and shocked, but she doesn't look at Fuyuki with fear. This completely changes how the audience reads the scene, and by extension, how Eri feels safe with them.
