Ok first off, i questioned whatever kissing somebody who is asleep is rape ( and i should point out that molestation and rape are different things )
It could never be molestation as that would require one of them to be below legal age.
And i would still hold by that kissing somebody is not rape as its not actual sex.
Rape by definition is to engage in sexual intercorse against somebodys will/ without consent.
But if you want to go down this rabbit hole, i guess everybody who have kissed someone who is asleep is then a rapist.
Or if you want to be more extreme, everyone who ever kissed a baby as they are unable to give consent.

Secound of all the relationship between two people is irrelevant when it comes to what is and isent rape.
