Unlikely to be a copyright since the controller used as a basis is a 2 button model while the 4 button model of Nintendo controller looks completely different. Also the D-pad has been altered. Changing the button layout to match Nintendo layout wouldn't be the tipping point and it's obvious what the inspiration was anyway.
