Product identity is not trademark or copyright. You have every legal right to use mind flayers as you see fit, provided you aren't trying to convince people you're selling a Wizards of the Coast official product. You could go out and sell mindflayer t-shirts right now and you'll be safe as long as you have 'not associated with WotC' somewhere.
IIRC, the term Illithid will get your ass sued regardless.

@Illuvatar9 Mindflayers are super-duper strong. As you saw, this one was level 8; that's much too strong for them to deal with at their level. Even with a sneak attack, they would have gotten their asses whupped. That's why he wanted to try and solve it through diplomacy or something if possible. Also why he yelled at her not to attack.

mindflayer has a challenge rating of 8 thats the same as a tyrannosaurus
they are ridiculously overpowered...
and in praxis they are harder to kill than adult dragons .... at least that damn dragon cant flee to a different realm

well but not quite like this normaly mindblast is a cone ability not a centered aoe and has a 6round cd

it can stunlock 2+ charackters with its skills unless they beat an insane intelligence check and needs physical attacks to be beaten (advantage against magic)
so it is weaker against physical types but to withstand its stun you need a intelligence save which is the weakness of physical types...
