Probably not the first company to do that. If Merryweather decides to push back (and I strongly suspect they will), this could be an interesting drama to watch play out.

5. It's been a year since the DMCA for those chapters. Would Merryweather pursue something now if they hadn't already pursued something in the past year?
I am assuming that uploaders that had their uploads DMCA'd would have been notified about this already, but maybe I'm assuming too much.
